How Safety Consulting Company can Help You in WSIB Claim?

What is WSIB and How Does it Work?shutterstock_51235186

  • WSIB stands for Workplace safety & Insurance Board. This is an Ontario government agency that used to be called the Workers Compensation Board. Even to this current date many people succumb to their injuries or illness at their respective workplaces; this is especially necessary in high risk work environments. Thus this agency was established, the WSIB.
  • WSIB is an agency that helps and protects workers; especially those who work in high risk environments. It makes sure the workers receive good compensation in case of an accident at the workplace. In addition to which the worker is also liable to benefits for loss of earnings due to the accident as per the Ontario Workplace safety and Insurance Act.
  • In fact the employer contributes towards an insurance fund which is usually province wide and their premiums are usually based on the employer’s payroll and their safety history as well.
  • The way this works is that the injured worker is compensated by the WSIB on a no fault basis; in the sense compensation is paid no matter who’s fault it is. In addition to which the employer is shielded from other liabilities. This effectively means that the employer cannot be sued for negligence.

Working of WSIB:

The working of the WSIB is quite straight forward as explained in slightly more detail here:

  • The employers contribute to a province wide insurance fund which may differ depending on the type of company. For example if it is a mining company the contribution would be slightly higher as compared to a restaurant.
  • In case of an incident the compensation is paid to the worker no matter who’s fault it is. The employer too benefits from the deal since he is then shielded from liability of any kind.
  • In every incident the employer has the right to question the cause and place of the incident. The employer can very prove that the incident took place while the employee was not on the work premises if he has such information.
  • Both the WSIB and the employer work together towards getting the worker making sure the worker recovers fast and is able to go back to his regular duties. In some cases it is also necessary for the employer to accommodate the worker by assigning him simpler tasks.
  • The worker has additional rights, in the sense that if the claims for benefits are either rejected or stopped for some reason the worker has every right to contact the Union for assistance and advice.

Injury at work claim?

  • There are several procedures and routines that the worker should be aware of if they ever have the need to file a claim. To start with it is necessary to immediately notify the employer about the accident or occupational disease.
  • In case of an injury the employer will usually have a first aid kit that the worker can use however if further assistance was necessary the incident needs to be reported to the WSIB within three days.
  • Besides which the worker should obtain a professional health report from the doctor that he has treated him. Additionally he should also report it to the union or health and safety representative.

  • It is necessary that you give your doctor special permission to share information regarding the treatment or functional abilities the employer. This basically is information about the worker’s limitations due to the injury.

A Brief Introduction To WSIB

What is WSIB & it’s benefits?

WSIB is short for “The Work Safety and Insurance Board” and is an independent agency that is involved in administering compensation and no fault insurance to the Ontario workers and workplaces in Ontario and in fact it extends throughout Canada. The service they provide benefits the workers as well as the employers and comes at a small cost. The advantage being they are highly accessible and fast. The services they provide to the workers and the employees include the following:

  • The employer cannot be threatened by any employee for work related injury or illness. This means the employer cannot be sued either.
  • The employee on the other hand will receive loss of earnings benefit in case of an accident.
  • They provide the employee other benefits as well when work place incidents occur, like coverage for health care costs and even supporting and helping them to get back to work.
  • The get back to work help provided includes training for new skills if required or adjusting the duties at the workplace due to the injury if necessary.

Why WSIB is required?

Now that we know what is WSIB?, why is it required? Workplace safety is a major topic and more number firms and workers are now aware of this. However even though the safety level may have been increased or the employees awareness process being followed there are still many accidents at the workplace. Here are some statistics to support these facts:

  • Approximately 4628 workers lost their lives due to workplace incidents in 2012.
  • More recently, over 250 workers lost their lives in a mine in Turkey when the mine collapsed in May 2014. These were workers from all around the world including Turkey.

Thus the WSIB benefits clearly make it beneficial to both the employee and the employer. It provides a clear list of guidelines to make the process simple.

The WSIB Certification:

In order for a Joint Committee member to be able to approve certification training programs, there is a certain standard that must be met. This standard is developed by the WSIB. In addition to which if a certified organization does not meet the standards laid out by WSIB, they can reduce its funding or take over operations of the facility.

WSIB Training:

WSIB training handles almost all the matters pertaining to the safety at the workplace. This includes the training of the employees and employers alike. In addition to which it can allocate funds for the first aid training. This training can also be done via approved certification training programs.

Employer Accreditation:

WSIB also has the authority to accredit employers that meet the standards for the health and safety policy and operate successful programs related to health and safety. But that’s now all they are also the ones who develop the standard.

Additional functions:

WSIB has several other functions as well that mentioned here:

  • They fund occupational health and safety research.
  • Advising the Minister of Labour on matters pertaining to occupational health and safely.
  • Increase awareness of occupational health and safely amongst the people

What every worker should know About The WSIB

What is wsib:

Millions and millions of people go to work every day. Every day there is some an incident of some kind involving a worker. The incident is at times an injury at the workplace, an illness due to the exposure to hazardous substance and at times it is even fatal. This is the sad reality of work place environment (safety) so you have to know about wsib claims for it.

There are several statistics published every year on this topic. As per on such statistic approximately 4628 workers lost their lives due to workplace incidents in 2012. The figures speak for themselves and in spite of this there are some places that do not even consider providing workplace security and safety for the workers.

In an incident that occurred as recently as May 2014 in Turkey, more than 250 workers were injured in a mine accident. These were workers from many different countries besides Turkey.

So, In your mind what is wsib? WSIB (Workplace Safety & insurance Board) which used to be called Workers Compensation Board at one point in time plays a very big role in the case of any workplace accident. This is an Ontario government agency that helps both the employers and the employees (workers). Now that you know what is WSIB, this articles goes on to explain what is WSIB insurance, who is covered by WSIB, the coverage, cost and service in more detail.

Coverage provided by WSIB:

Basically WSIB provides workplace insurance, however it means different things to different people (workers and employers). As far as the employers are concerned if a work place injury does take place, then they need not be worried about getting sued by the workers (who are covered by WSIB). What it means for the workers ins quite different though.

In case of a workplace incident and in the condition where your claim has been approved, WSIB can provide loss of earnings benefit and coverage for health care costs who is covered by wsib. In addition to this they also provide support for getting you back to work. This may involve being assigned a different set of duties to suit your working abilities.

Who does WSIB Cover:

Who the WSIB cover is determined by the Workplace Safety and Insurance Act. In general if your type of work is covered under the Act, then you are covered. The procedure involves the employer having to register themselves (Company) and pay a periodic premium in exchange for the coverage. WSIB is not mandatory for businesses thus it does not automatically apply to everyone. However you can choose to be covered by WSIB.

The Bill 119 or Mandatory Coverage in Construction:

This is pertaining to the changes made to the Workplace Safety and Insurance Act by the Ontario Government on January 1st 2013. As per this change it is mandatory for most workers in the construction industry to have a coverage with WSIB. If you need more information on this topic it is best to order a mandatory coverage brochure by sending your business name, address and the number of brochure you require to neewsibcoverage@wsib.on.ca

The cost of the coverage:

The cost of the coverage is highly dependent on your earnings and the business activities. For example your business does not necessarily have to pay premiums based on 100% of your earnings. There is something like insurable earnings. However at the end of the day the insurable earnings depend on the type of business and thus it is something you may need to investigate further with all the relevant information. For example if you do construction work for only part of the year, you may not need to pay premiums on your earnings for the full year.

The role of WSIB in case of workplace accidents

In case of injury or illness: overview

The role of WSIB in case of workplace accidents

Workplace injury is a sad reality of daily life. There are some workplaces that are more risky than others. For example a construction site and even a mine are two places that are very risky to work. And this is based on real facts on not just assumptions.

WSIB (Workplace Safety & Insurance Board) is an Ontario government agency which used to be called the workers compensation board at one stage. This now plays a big role in case of any workplace accidents and is helpful to both the employers as well as the workers (employees). This article explains the role of WSIB in more detail.

Reporting the injury or illness:

There are a few things to keep in mind when a worker is injured at the workplace as mentioned here:

  • First Aid should be given immediately making sure proper standard is followed. In addition to which the incident should be reported as soon as possible.
  • Ideally the employee should get in touch with their WSIB account representative so that WSIB can make sure appropriate help and is provided to all concerned.
  • It is the duty of the employer to arrange transport of the injured worker to get medical treatment and go back to his house if necessary.
  • It is good practice for the employer to pay the injured worker the full day’s wages as well keeping in mind that the WSIB injury of earnings benefit doesn’t start till the day after the incident.
  • The employer should make sure he learns from every accident that occurs and does his best to make sure he does the necessary to avoid similar incidents happening the future.
  • In case of fatal incidents it is important to notify the Ministry of Labor, providing them all the circumstances of the incident.

You must report the incident to the WSIB within 3 days:

Any incident involving a worker needs to be reported for the wsib claims as soon as possible. Whatever the case is an injury or an illness the incident needs to be reported within three days.

The report is usually made using the WSIB Accident Report Form, Form. The form is accompanied along with a Form 7 reference guide. In addition to which there is also an e-Form available for the same which makes it easier and more convenient for employers to handle the reporting.

In general it is a legal requirement to report the any such incident with 3 days of it occurring.

Reporting Workplace Accidents:

There are certain situations in which you must report an incident to the WSIB within three days with wsib injury report; they are as below:

  • If the worker loses time from work.
  • If a worker earns less than a regular day’s pay.
  • If a worker gets health care treatment.

There are many things covered include the health care costs, doctor’s visits, the prescriptions, even the care in hospitals and other health care facilities.

Additionally physiotherapy, chiropractor’s visits and eye glasses and processes are also covered.

However there are several conditions in which the incident does not need to be reported as mentioned here:

  • If the minor cuts and bruises or scratches of the worker only need cleaning.
  • If the worker needs treatment of a minor burn.
  • The minor injury of the worker needs applying of a bandage, a cold compress or an ice bag.

There are also some cases in which you can wait up to 7 days to report an incident as mentioned here:

  • If the worker requests for modified work at full pay. This often happens when a worker is injured or suffering from an illness. In such cases either his working hour are reduced or a different set of duties are changed.
  • In cases where the workers are exposed to infectious diseases.

How to initiate a WSIB Claim:

The process of initiating a WSIB claim and Wsib injury report is easier than you think, besides the benefits of doing so far out weight the consequences of not doing so. To file a claim for the benefits simply follow the steps below:

Reporting the incident: As soon as you come to know about the an injury of or illness of an employee it is necessary to fill in the necessary details in the ‘Form 6’ provided for wsib accident report form. The advantage of doing this is that you have all the facts with you at the time and thus will be in a better position to fill the form. There is usually a time limit for filing claim, to make successful claims. A claim must be filed within 6 months of an incident; whatever the case be an accident or an illness.

Physical and mental condition of the injured: The functional abilities of the injured are required to be assessed by the physician. In addition that the worker needs to provide consent that his medical condition be shared with his employer. The advantage of doing this is that all concerned are made aware of the limitations of the worker due to the injuries sustained. This is required if you to make a claim.

Few Important Tips:

  • It is important to understand what WSIB defines as an accident. An injury that is caused due to falling, or a gradual injury being developed over time or even a illness caused due to the exposure to harmful substances are easy incidents which are easy to wsib claims.
  • It is vital that you as a worker give a detailed report of the injuries or illness immediately to the employer. A small incident like ache, pains or muscle pull should be reported as soon as possible since such injuries can develop into something more serious very fast.
  • It necessary to fill in the employee incident form too.
  • It is also necessary for the doctor who examines you to make a note of his observations in the Form 8 to the WSIB.
  • At times it is possible to change the set of duties while the injury still persists. This helps the process of getting back to work after an injury.
